## Recitals
WHEREAS, the Conservator has been appointed by the court to manage the personal and/or financial affairs of the Conservatee;
WHEREAS, the Conservatee is in need of assistance in managing their personal affairs due to incapacity, age, or disability;
WHEREAS, the Conservator is willing to serve as such under the terms and conditions set forth in this Agreement;
NOW, THEREFORE, in consideration of the mutual promises and agreements to be kept and performed by each party, the parties hereby agree as follows:
## 1. Appointment of Conservator
1.1 The Conservatee hereby appoints the Conservator to act on their behalf in accordance with the laws governing conservatorships within the jurisdiction.
1.2 The appointment shall be effective as of the date of this Agreement and shall continue until terminated, either by court order or by mutual agreement of the parties.
## 2. Responsibilities of the Conservator
The Conservator agrees to:
2.1 Act in the best interest of the Conservatee at all times.
2.2 Manage and control the Conservatee's assets, including but not limited to bank accounts, real estate, and other investments.
2.3 Make necessary arrangements for the Conservatee’s medical care, daily living needs, and other personal affairs.
2.4 Keep accurate records of all transactions and decisions made on behalf of the Conservatee.
2.5 Provide periodic accounts to the court as required by law and ensure compliance with any reporting requirements.
## 3. Rights of the Conservatee
The Conservatee retains the right to:
3.1 Participate in decisions concerning personal welfare to the extent possible.
3.2 Be informed about the status of their affairs in a manner that is understandable.
3.3 Seek modification or termination of the conservatorship in accordance with applicable law.
## 4. Compensation of the Conservator
4.1 The Conservator shall be entitled to reasonable compensation for services rendered, subject to court approval and in accordance with applicable laws.
4.2 Expenses incurred by the Conservator on behalf of the Conservatee shall be reimbursed from the Conservatee's funds.
## 5. Termination of Conservatorship
5.1 This Agreement may be terminated by:
a. Mutual written agreement of both parties.
b. A court order based on the finding of the Conservatee’s ability to manage their own affairs.
c. The death of the Conservatee.
## 6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of __________.
## 7. Amendment
This Agreement may only be amended or modified in writing, signed by both parties.
## 8. Severability
If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
## 9. Entire Agreement
This Agreement constitutes the entire understanding and agreement between the parties and supersedes all prior agreements, understandings, or negotiations, whether written or oral, regarding the subject matter herein.
